1. RENTAL
The rental is considered to be concluded in the name and on behalf of the owner or the person responsible for the property, at the prices and conditions indicated on the website booking.isulatravel.com. IsulaTravel is a trademark of IsulaTravel srl, with registered office in Modica (Italy) - Via della Costituzione, 43 - VAT IT01321140889. The rental contract is therefore concluded between the owner and the person who makes the online booking. The person who sends the online booking acknowledges and accepts that he or she has the legal capacity and authority to bind each and every person on whose behalf the booking is made.
The person who confirms an online booking authorizes IsulaTravel srl to use the personal data of all the people who participate in the booking, in accordance with our privacy policy;
2. HOW AND WHERE TO BOOK
Customers can make reservations and related services exclusively through the website booking.isulatravel.com. The reservation implies knowledge and acceptance of the terms and conditions included in this document. The person confirming the online booking declares that they are at least 18 years old at the time of booking. All other members of the party must authorise the person to make the booking on the basis of these booking conditions. All booking details are deemed to be accepted by the client and his Party unless, within 24 hours of the online booking, you notify us by email that you wish to change or cancel the booking arrangements.
3. PAYMENTS
Upon receipt of an email confirming the availability of the property or confirming an online booking, the client must pay a deposit, by credit card, bank transfer or paypal, equal to 25% of the total amount due. Upon receipt of this payment, a booking confirmation will be sent to the client by email. The balance payment for villas and apartments must be made at least 61 days before the start of the rental period. For reservations made within 60 days prior to the start of the rental period, the customer is required to pay the full amount of the reservation at the time the request is made or the deposit in the event that the particular property requires payment of the balance on site.
4. RENTAL GUIDELINES - PRICES
The minimum rental period for villas is normally one week, from Saturday to Saturday (unless otherwise specified in the property description). In special cases, IsulaTravel reserves the right to accept reservations for shorter periods at its discretion. The prices published on the site are set according to market conditions and in agreement with the owner or manager.
The rental prices published are calculated per day or per week depending on the property, as clearly indicated in the price table. All prices are inclusive of the services included in the property and specifically described and are divided according to the seasons as displayed on the site. Any other mandatory extra services not included in the published price must be paid in advance or, in some cases, directly to the owner or the person in charge in cash in Euros upon arrival. Mandatory extra services are described both on the website and on the voucher. IsulaTravel reserves the right to change the prices of its properties at any time. No additional amount will be charged to a customer who has already booked and paid the rent for a property, whose rental rates are subsequently increased. In the case of properties that include multiple accommodation units with different price ranges and that can be rented separately, the customer has the right to use only the unit he has requested, the other units will remain closed and unavailable. These units can be opened and made available only if the customer pays the amount corresponding to the rent for that unit for the expected period and only if the owner is able to make it available.
5. VOUCHER, CHECK-IN AND CHECK-OUT
In order to access the property, all guests are required to complete the “online check-in” procedure that will be sent via email 3 weeks before the check-in date. This procedure is essential as it contains all the information required by law for the registration of guests at the police office. Once the online check-in procedure is received, it will be checked and verified by Isula Travel srl, then the customer will receive the voucher and tourist documentation via email, including arrival information and the contact details of the check-in manager. The check-in time for all properties is from 4:00 PM to 8:00 PM. Check-in after this time is subject to the payment of €50.00 to be paid in cash upon arrival. Customers are required to call the owner or the person responsible for the property at least 2 hours before their arrival. The arrival time must be communicated to ISULATRAVEL at the time of booking by indicating it on the Check-in Form located in the customer area. The check-out time for villas and apartments is by 10 am on the agreed day of departure. Customers must, without fail, leave the property by this time, unless otherwise agreed with the owner or the reception manager. In case of delay in clearing the property beyond the agreed time, the customer will be charged a full day's fee.
6. CANCELLATION POLICY
The general cancellation policy is as follows:
For cancellations up to 61 days before the arrival date, 0% will be charged
For cancellations up to 30 days before the arrival date, 50% will be charged
For cancellations after this date: no refund will be due.
However, each of the properties listed on booking.isulatravel.com, may have different cancellation policies, as written in the "policies" section included in each individual property page.
7. ARRIVAL FORMALITIES
Upon arrival at the property, the customer must deliver the voucher to the owner or manager, even if not expressly requested. The voucher contains any extra services to be paid on site. These services are also published on the website. Without a voucher or if not described in the voucher, the publication of the services in the price table of the booked property prevails. The customer is required to pay the amount due for extra services not included in the price upon arrival in cash in Euros. If this does not happen in whole or in part, the owner may withhold the sums due from the deposit.
8. SECURITY DEPOSIT
A security deposit is required. The amount of the deposit will be blocked on the customer's credit card 7 days before arrival and will be unblocked within 15 days from the check-out date. From this amount will be deducted the cost of repairing or purchasing any items damaged by the customer. In cases where the damage cannot be immediately assessed on site or both parties are unable to reach an agreement, the owner/agent will retain the entire amount of the security deposit and will send the customer a detailed list of the costs of repairing or purchasing the damaged items requesting, if necessary, an additional amount from the customer or returning part of the deposit. The security deposit is due in the amount indicated on the booking confirmation. In any case, the customer is always responsible for any type of loss or damage caused to the property or its contents during the stay. In the event of damage, IsulaTravel always reserves the right to charge the customer the amount in question. In no case will the owner and IsulaTravel be responsible for any damage to people or things during the stay in the rented premises. The care and safety of children is the express and exclusive responsibility of the parents/guardians. In no case can the owner, the person in charge of the property or IsulaTravel be held responsible. IsulaTravel declines all responsibility in the event of disputes relating to the security deposit. The quantification of the damage and the subsequent agreement must be made between the customer and the owner or the person in charge of the property.
9. NUMBER OF PEOPLE - SUBSTITUTION OF PEOPLE - ANIMALS - USE OF THE PROPERTY
Entrance and stay in the property is permitted only to the number of people indicated on the voucher. Their number (adults and children from 3 to 12 years) cannot exceed the number of beds indicated in the description. Children from 0 to 2 years are not considered in the number of people. Children over 12 years are considered adults. Any substitution or addition of people present during the rental period not communicated at the time of booking is strictly prohibited unless previously agreed with IsulaTravel. In this case, the owner or manager of the reception may reserve the right to refuse entry to people not previously declared and in such circumstances the customer has no right to claim from IsulaTravel, owner of the property or responsible, a partial or full refund of the fee already paid. The person making the reservation is considered to all intents and purposes the leader of the group, will act as a representative of the people staying with him in the house and is responsible for the entire group. In some cases, and at their discretion, the owner of the property or the person in charge may have one or more members of the group sign the contractual documents. All people in the group are required to show and deliver a copy of their identity documents to comply with current safety regulations. Without this data, the owner/manager of the accommodation may reserve the right to deny guests entry to the property. If the property accepts pets, the customer is required to inform IsulaTravel in advance of their size and number. The customer is responsible for the behavior and cleanliness of the animal. If the animal were to cause damage to the property or cause hygiene problems for subsequent guests, the owner of the animal will be fully responsible and will be required to compensate the cost of damage caused to people or things. In some cases pets are accepted on the condition that they remain outside the property, in areas dedicated to them (gardens, cellars, etc.). In such cases, the entry of the animal into the property, for any reason, is strictly prohibited. It is forbidden to use our property for parties or gatherings where the occupants of neighbouring properties could be disturbed. If, on arrival, it is believed that you intend to use the property for such an event, entry may be refused. If it is discovered that you are organising such an event after arrival, you will be asked to leave immediately. In such circumstances, we are not obliged to provide or locate alternative accommodation. The proportion of any refund is at our discretion.
10. CLEANING and ELECTRICITY
The houses are delivered clean and tidy. In some cases the price includes this service. If this service is not included in the price the customer must pay the owner or the person in charge the amount, in cash in Euros on arrival as indicated on the site. The amount does not include, in any case, the removal of waste and/or large or bulky objects (full bags, plastic pools, toys, inflatable objects, boxes, glass bottles, etc...), which is the sole responsibility of the customer. In the absence of this, the owner or the person in charge may, at their discretion, charge an additional fee of up to €100 in addition to the amount due which will be retained from the security deposit if requested or, alternatively, upon direct request to the customer. In some cases, electricity consumption is not included in the rental price (if specified in the property description) or a maximum daily or weekly consumption amount is established. In such cases, the customer will have to pay the owner or the person in charge an amount corresponding to the consumption during his stay in the property which will be charged at the rate applied by the Italian electricity company ENEL (generally Euro 0.35-0.45 kw/hour) or at the rate established on the website under the list of extras applicable to the property.
11. HEATING
Given the energy supply situation and the laws currently in force, the use of heating (switching on or off period, temperature) is regulated by provisions that vary from one municipality to another. Generally, heating systems can operate from November to April. Consequently, even when heating is included in the rental price, it is intended to be used during that period. If heating is charged according to consumption or as an extra and has not been paid in advance, the customer will pay the owner or the person in charge directly in cash upon arrival in Euros.
12. INTERNAL AND EXTERNAL MAINTENANCE
In case of need, the owner or the person in charge reserves the right to allow entry into the property by staff to carry out the necessary maintenance and / or cleaning work at times of their choice or, where possible, at times agreed with the customer if expressly requested by them.
13. RESPONSIBILITY Each property has been visited and inspected by IsulaTravel. The descriptions on the website are correct and written in good faith; IsulaTravel therefore declines all responsibility for any changes made without notice by the owner or manager, unless the problems are of such a serious nature that they make it impossible to stay in the property. Should problems arise, the client must do his best to resolve them and/or reduce them to a minimum, in order to avoid further negative effects that may arise. In the event that the client is unable to take possession of the property due to its uninhabitability, the client must contact IsulaTravel immediately to inform us of the conditions. The client must allow IsulaTravel the necessary time to attempt to resolve the problem. If the problem cannot be resolved, IsulaTravel will endeavour to find alternative accommodation. In the absence of communication of the above or for reasons other than uninhabitability, clients who leave their accommodation before the scheduled date will lose all right to a refund of the rental price. For any complaint made after the end of the stay, the customer is not entitled, for any reason, to compensation of any kind. No refund or change of property is permitted unless the property is deemed unfit for use. If IsulaTravel is forced, by force majeure or any other reason beyond its control, to cancel the reservation relating to the property booked by the customer, in agreement with the customer, alternative accommodation of the same class or better will be offered, provided that IsulaTravel is in its power to offer such a solution. If the price of the replacement accommodation is lower, IsulaTravel will refund the difference to the customer. In cases where an alternative property cannot be found, IsulaTravel will refund the customer only the price paid for the rental, excluding all other expenses. This refund will be made within 60 days of the date of the stay. Many of the properties are private homes. As such, they do not have internationally recognised standards or categories applied to them, but rather reflect the architecture and furnishings as well as local traditions and the personal tastes of their owners. By choosing one of these properties, customers have the opportunity to experience the local culture first-hand by living in the same environment as the locals. To do this properly, customers must accept and appreciate the possible differences that the accommodations offered by IsulaTravel present compared to where they normally live. However, IsulaTravel does not exclude that some differences may sometimes cause small inconveniences which, being related to the characteristics of the property itself, will not be accepted as complaints. WIFI Internet connection is provided in the property. There is no charge for normal use. In the event of a loss of connection, Isula Travel will endeavour to reconnect as quickly as possible, but we cannot be held responsible for any losses resulting from the loss of connection. Where Wi-Fi is an advertised facility, please note that its provision is subject to availability and network conditions. It may not be available 24 hours a day and is provided for pleasure, not for commercial purposes. Cancellations/refunds/complaints will not be accepted if they are entirely dependent on the uninterrupted and unlimited provision of Wi-Fi. Many of the properties rented are equipped with a remote surveillance service for security purposes, through the use of CCTV. The tenant expressly declares that he is aware of and accepts its presence and use. We may terminate a stay after the keys have been handed over, if the unreasonable behaviour of anyone in your party (including anyone invited into the property by you) is likely to spoil the enjoyment, comfort or health of other guests, residents, neighbours or staff or where you or any member of your party (or anyone invited into the property by you) has breached or is likely to breach any of these booking conditions. If this happens, you will have to leave the property immediately and no refund will be made. To ensure a quality standard IsulaTravel collects customer feedback to better identify problems to eliminate or minimize them. 14. CONTRACTUAL CLAUSES The completion and sending of the information and booking form with payment of the amount requested for the property, implies knowledge of the general contract conditions of IsulaTravel and their unconditional acceptance. If some conditions of this contract should or should be invalid or, in the event of omission, the validity of the remaining conditions cannot be questioned.
15. DISPUTES
For all disputes that may arise following the application, interpretation, validity, enforceability, execution and termination of this contract before the initiation of any arbitration or legal proceedings, the parties will attempt conciliation pursuant to Legislative Decree 28 December 2010 and subsequent Min. 180/2010 and subsequent Min. 145/2011 according to the conciliation rules of an Organization registered with the Minister of Justice. If such conciliation attempt is unsuccessful or is not resolved within 4 months of the request for mediation, the dispute will be referred to the competent judicial authority of the Court of Ragusa - Italy.
16. COMPLAINTS
If upon arrival or during the stay the guest should encounter problems in the booked property or discrepancies with the booked services, he/she must notify Isula Travel srl within 24 hours. In this case, the Isula Travel srl staff will check on site and evaluate together with the customer how to resolve them, if any.
If it is not possible to resolve them, the customer can decide to accept the accommodation anyway and stay there without claiming anything or to leave the property within 24 hours and subsequently submit a request for reimbursement that Isula Travel srl will manage depending on the situation.
